Phoenix Electric Light Parade Reminds Residents to Drive Safely

By Auto Accident Lawyer on January 25, 2012 - No comments

The law team at Breyer Law Offices, P.C. was happy to see that everyone enjoyed the weekend of the Electric Light Parade. The parade has been coming to Phoenix for 25 years, according to AZ Central, and drew tens of thousands of spectators. Many lined the sidewalks first thing in the morning, although the parade did not take place until nighttime.

Avoid Phoenix Car Accidents: Parade Route

When parades are taking place, it is important that all drivers slow down, watch for pedestrians, remain aware of other cars, obey all traffic laws, and stay alert. The Electric Light Parade ran along Central Avenue from Montebello Avenue to Camelback Road. It then turned east on Camelback Road to Seventh Street and then south to Indian School Road. Admission was free. The roads were shut down to through-traffic, and motorists were warned to expect heavy traffic in the area, as well as pedestrians and, unfortunately, distracted drivers.

Phoenix Car Accident Statistics

While 2009 marked the lowest number of Phoenix auto accidents in 20 years, there were still more than 12,000 people injured in the city and 136 people died, according to a news report in AZ Central. Also, the roads that were the most accident-prone in the city include many along the Electric Light Parade route, including Camelback Road and Indian School Road.

Injury Lawyer Discusses Arizona Bill to Ban Children from Riding in Truck Beds

By Auto Accident Lawyer on February 9, 2011 - No comments

For nearly 20 years, Arizona law makers have failed to pass a ban on minors riding in the back of trucks. According to Cronkite News Service, three state representatives have co-sponsored a bill that would not allow anyone under the age of 18 to ride in the back of an open vehicle without proper restraints. It is interesting to note that Arizona currently has laws regulating how to restrain a refrigerator in the back of a truck, but not a child.

The National Highway Traffic Safety Administration (NHTSA) reports that on an average, 50 people die annually as a result of riding in the back of trucks without proper restraints. Many believe that this annual number is decreasing as more states pass laws banning this type of travel.

No amount of laws and regulations will prevent all serious injuries. A majority of Arizona car accidents are caused by driver negligence. If you are injured in an Arizona motor vehicle accident caused by someone else’s negligence or wrongdoing, it would be in your best interest to speak with a skilled Arizona personal injury attorney, who will fight for your rights.

A personal injury claim is a civil lawsuit that allows a victim of negligence to pursue financial compensation for the injuries and losses suffered in an accident. NHTSA Report Finds Drug Use of Fatally Injured Drivers Has Increased

By Auto Accident Lawyer on January 12, 2011 - No comments

Recently, the National Highway Traffic Safety Administration (NHTSA) announced that post-mortem test results showed a rise in drug involvement levels among drivers that were fatally injured from 2005 through 2009. The study was the first time drug involvement among deceased drivers in fatal car crashes was analyzed.

According to NHTSA data, there were 21,798 drivers that died in car crashes in 2009; 63 percent of them were drug tested. About 18 percent, or 3,952 people, tested positive for using drugs in 2009. Additionally, the study discovered that states reported drug use among drivers that were fatally injured rose steadily each year; from 13 percent in 2005, 15 percent in 2006, 16 percent in 2007, and 18 percent in 2008. However, drug use does not necessarily mean the driver was driving while impaired or that the use of drugs was the reason for an accident.

The data was gathered by the NHTSA and fell into three categories: if the driver was tested, what type of test was conducted, and the results of the test. The kinds of drugs reported in the data included legally prescribed drugs, over-the-counter medications, and illicit drugs, such as depressants, stimulants, narcotics, hallucinogens, phencyclidines (PCPs), inhalants, steroids, and cannabinoids.

NHTSA Administrator David Strickland stated, “Every driver on the road has a personal responsibility to operate his or her vehicle with full and uncompromised attention on the driving task. Today’s report provides a warning signal that too many Americans are driving after having taken drugs, not realizing the potential for putting themselves and others on the highway at risk.”

All motorists are legally required to operate their motor vehicle in a responsible manner that will not cause themselves or others harm. Unfortunately, as this study by the NHTSA shows, not all motorists adhere to traffic laws that are in place for the safety of everyone on the road. Victims who have been injured in car accidents in Arizona that were caused by a dangerous and negligent driver may pursue compensation for their injury and losses by filing a personal injury claim. They may be able to receive coverage for medical expenses, hospital bills, loss of present and future wages, physical therapy costs, vehicle damage, and more.

Personal Injury Attorneys in Tucson for Intersection Car Collisions

By Auto Accident Lawyer on April 2, 2010 - No comments

Many Arizonans believe most serious personal injury cases that Arizona lawyers take on involve freeway accidents. While this is often true, intersections that we drive through every day are where people commonly suffer severe injury and even wrongful death. When there is an accident at an intersection, there are many factors that should be considered by top Phoenix personal injury lawyers.

Firstly, a full reconstruction of the accident must be done to determine who contributed to the accident. Too often people consider that there is only one person who is “at fault” in an automobile wreck at an intersection. Arizona personal injury law, however, divides the fault among all the factors that contributed to the accident. In a Tucson intersection accident, there may be only one person who is at fault. In another situation, multiple people may have contributed to the serious injuries of an innocent car crash victim. In some intersection accidents, the person who was seriously injured may also share blame.

In other cases, it could be that the intersections is poorly designed or maintained, and that situation may have contributed to the accident. Since there may be a plethora of people who share in the fault of any Phoenix intersection car accident, it is usually the best course of action to find a top personal injury attorney in such cases. Finding a competent trial lawyer with personal injury experience who can give you honest answers to your questions is a vital first step for any party injured in an intersection accident.

Should you have questions about how Arizona intersection accidents are processed or the laws that may relate to your claim, we invite you to call us. Our Tucson car accident lawyers are happy to answer any questions about intersection accidents.

Finding a Lawyer for an Accident Case When Somebody Has Been Cited with ARS 28-701(A)

By Auto Accident Lawyer on March 17, 2010 - No comments

When a police officer shows up for a very serious accident and believes somebody should have been able to stop their vehicle in time and avoid an accident, the driver that the police officer believes to be responsible is often cited with ARS 28-701(A). This is for failure to control the speed of the vehicle to avoid a collision. This is a very common citation in many serious personal injury cases throughout Arizona. However, it is important to remember that the determination of the police officer does not end all questions in regards to how a serious personal injury case will be handled and who was at fault for that accident. First, the citation itself doesn’t say who was at fault. Instead, it says who is responsible for violating that specific law and statute. Also, the determination of the police officer is not final. Only a determination by a judge or a jury is final when it comes to who is responsible for an accident.

Many times, as Peoria car accident lawyers, we receive calls from people who were not cited in the accident and cannot understand why the other insurance company is refusing to accept responsibility for the collision. This is because they are not required to follow that citation and therefore in many cases hiring a top Arizona personal injury lawyer can be a vital step in getting them to accept the responsibility for the collision. Also, we have talked to many people who were hesitant to pursue a claim even though the facts showed that either none of the fault of the collision was theirs or much of it belonged to somebody else when they received a citation from the police. Again, determining who was at fault for causing a serious injury – or which set of different people may have all contributed to it – usually requires an expert reconstruction or analysis of the claim.

If you do not know where to turn after being involved in a very serious accident, please feel free to give us a call. If you are concerned about a “sales pitch” you need not be. We will give you an honest assessment of your claim. We will tell you if we think you have a case to pursue and, if not, we will explain why. If we do think there is a claim to pursue we will let you know whether we are willing to help you with the case and, if we are not, we will try to offer you guidance as to what direction you can turn for the best possible resolution of your claim.
