4 Ways Your Insurance Company Will Try to Deny You Compensation

After being involved in a car accident that resulted in injuries a person may considering filing a claim with their insurance companies. It is important to remember that the insurance company wants to protect and increase their profits. One way insurance companies are able to do this is by denying compensation to a client who was injured by the negligence of another. Insurance companies deny responsibility for four main reasons. In order to protect your claim many chose to hire a Phoenix traffic accident attorney. An attorney can work to make sure that an insurance company does not attack your credibility

Here are the four ways an insurance company can deny compensation:

1) Deny Coverage

An insurance company may try to deny coverage if alcohol, drug use, or reckless driving was a factor in the accident. Insurance companies will utilize their contract signed by their client to prove that they are not responsible for accidents caused by illegal behavior.

2) Deny Causation

Insurance companies may try to deny that any injuries or property damage even occurred as the result of an accident. The insurance company may also claim that the party accused of causing the accident is actually the victim and innocent. If the insurance company can prove that a persons injuries were not caused by the accident and were instead preexisting they will deny all coverage.

3) Prove Contributory Negligence

Insurance companies often look to blame the injured party for the accident. In most states the amount of money awarded to the injured party is reduced according to responsibility. If the injured party is responsible for 20% of the accident they will receive a reduction of $20,000 from the original $100,000. In a few states if the injured party is responsible for 50% of the accident they will not receive any compensation.

4) Prove the Presence of Alternative Compensation

If an insurance company can prove that a person is receiving compensation from another insurer or party then they may be able to deny responsibility.
