Parents: Warn Children about Pedestrian Accidents
As Tucson pedestrian accident attorneys, we were extremely sorry to hear about a 13-year-old boy who died Thursday, December 29, 2011 as he crossed the street with other children. According to Fox 10, the boy ran across the street without warning, and the 32-year-old driver who hit him did not have time to stop or avoid him. The boy was hit by the driver's SUV and died at a local hospital. The driver remained at the scene and was not cited for the crash. Our deepest condolences are with the victim's family and the other children who witnessed the crash.
Causes of Tucson Pedestrian Accidents
As Tucson pedestrian crash lawyers, we often see accidents that occur when pedestrians don't use crosswalks and when they don't wait for cars to stop. Still, just because a pedestrian doesn't cross in the crosswalk doesn't mean that the pedestrian is at fault for the accident. Many times drivers think they are not speeding when they actually are speeding. Further, many drivers could have avoided an accident, even if the pedestrian did not use the crosswalk, if they truly were paying attention.
Many drivers are just looking down and are not expecting a pedestrian to cross the roadway so they do not have the full view of the roadway. While the news tries to get all the facts, it remains that in times like these car accidents in Tucson, it is hard to get all the facts correct for the news. It may be that there is more information that the public does not know about this accident proving that the pedestrian was not at fault, or was at least not 100% at fault for this accident. The question is should the driver have seen the pedestrian. How far did the little boy get across the roadway? Was the driver going the speed limit or being distracted in any way? Did the driver look down and lose focus of the complete surroundings of the roadway?
